California Supreme Court Takes Prop 8 Case
The state Supreme Court will review legal challenges to Proposition 8, delivering a small but significant victory to same-sex marriage advocates seeking to overturn the ban in court.
Without elaboration, the court merely said that it would review three lawsuits seeking to overturn Proposition 8. The suits argue that voters did not have the authority to overturn gay marriage because it amounted to a revision of the state constitution, requiring a tw-thirds vote of the legislature.
Proposition 8 supporters have argued that the legal manuevers are efforts to overturn the will of the people.
Gov. Arnold Schwarzenegger predicted that the courts would overturn Proposition 8, just as they threww out Proposition 187, the 1994 initiative that denied health and educational services to illegal immigrants in the state.
The court refused to allow gay marriages until it rules.
